The Consumer Product Safety Improvement Act of 2008: How To Deal With Certificates of Compliance

Shock waves from the Consumer Product Safety Improvement Act of 2008 (CPSIA) are hitting any firm involved in exporting products to the US. New product safety standards, overlapping standards, multiple phase-in dates, new types of product testing -- all wrapped up in Certificates of Compliance (COCs) required for each shipment.
What goes into a COC? Should there be one form of COC for all products or separate forms for different product types (adult apparel, children's apparel, other children's products)? What is the coverage of a COC -- one invoice, even if multiple S/Ns, or one S/N only? The retail customer wants the COC to cover California Proposition 65 -- is this correct? What standards do apply and do any apply retroactively?
Mr. Delbyck will address these and other COC-related questions now vexing the trade. He will explain how to construct COCs, in terms of what should be in and what should be out, especially when dealing with children's apparel and other children's products subject to multiple product safety standards.
Mr. Delbyck is a U.S. customs and trade lawyer, with offices in Hong Kong and the San Francisco Bay Area, who represents firms at all points in the chain of supply, from factories to trading companies to buying agents to importers. He currently advises a number of HK-based firms on COCs and the CPSIA generally. Mr. Delbyck is a former AmCham Governor and Chairman of the AmCham Textile Committee, who has been a frequent speaker before the Committee on trade issues. This presentation is most timely.
