Structuring Buy-Sell Arrangements to Lower Dutiable Value

Roy Ian Delbyck
Law Office of Roy Ian Delbyck

Textiles & Apparel Committee

To: Members and Fellow Textile Industry Practitioners,
From: Peter Liu, AmCham Vice President and
Textiles & Apparel Committee Chair

Apparel continues to be subject to some of the highest duty rates around. Techniques to minimize dutiable value are therefore especially useful to the apparel trade. Mr. Delbyck, a Hong Kong and US-based customs and trade lawyer with long experience representing apparel companies, will detail the structures for lowering dutiable value, including the use of buying agents, dual agents, first-sale and LDP arrangements, and in the process clear away some of the popular misinformation concerning what can be excluded from dutiable value. The trade and professionals servicing it will find Mr. Delbyck's talk extremely useful in approaching their businesses and customers/clients.

Mr. Delbyck advises companies and addresses groups throughout Asia and the United States on a wide range of customs and trade and commercial matters. He is a former governor and a vice president of the American Chamber of Commerce in Hong Kong.
